Amy Chater from Leigh Day Solicitors talks about the Mental Capacity Act 2005 which was designed to protect and restore power to vulnerable people who lack the capacity to make certain decisions due to illness or disability.

She further discusses the two-stage test which determines whether a person is capable and what the next steps are if it is concluded that someone is not. Any decisions should always be made in their best interests and Amy explains the process that should be followed in those instances.
